MOTION.

Terms of Service

Effective November 1, 2026

1. Agreement and Eligibility

These Terms of Service ("Terms") are a legal agreement between you and Motion Group LLC ("Motion," "we," "us," or "our"). They cover your use of Motion: Social Events, including our mobile app, our website at motioneventco.com, and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms are between you and Motion only. They do not create an agreement between you and other users, event hosts, or partner businesses.

You must be at least 18 years old to use Motion. By using the Service, you confirm that you are 18 or older, that you can legally enter into this agreement, and that you are not barred from using the Service under any applicable law.

2. Your Account

You must give accurate information when you create your account and keep it up to date. You may only have one account, and it is for your personal use. You are responsible for everything that happens under your account, so keep your password private. If you think someone has accessed your account without permission, contact us right away at team@motioneventco.com.

3. Community Rules

Motion only works if people feel safe showing up. When you use the Service, you agree not to:

  • Harass, threaten, bully, or intimidate anyone, online or at an event
  • Post hateful, violent, sexually explicit, or discriminatory content
  • Pretend to be someone else or misrepresent who you are
  • Create fake, misleading, or scam events, or events meant to lure people somewhere unsafe
  • Promote or organize anything illegal, including illegal drug sales or serving alcohol to anyone under 21
  • Use another user's phone number or other contact details for anything other than staying in touch as friends, share it with anyone else, or keep contacting someone after they ask you to stop
  • Spam users, send unwanted promotions, or collect other users' information without their permission
  • Post content you don't have the rights to, such as someone else's photos or copyrighted material
  • Hack, scrape, overload, or interfere with the Service, or try to get around our safety features
  • Use the Service for commercial purposes without our permission, except as an approved partner business

You can report users, events, or content that break these rules in the app or by emailing team@motioneventco.com. We may remove content or take action on accounts at our discretion, but we are not required to monitor everything posted on the Service.

4. Hosting Events

If you host an event on Motion, you are responsible for it. That means you agree to:

  • Describe the event honestly, including its date, time, location, and what attendees should expect
  • Have permission to use the location you list, and follow its rules
  • Follow all laws that apply to your event, including rules on alcohol, noise, occupancy, and permits
  • Update or cancel the event promptly if plans change
  • Treat attendees respectfully and take reasonable steps to keep your event safe

Motion is a platform for finding and sharing events. We do not organize, run, supervise, or control events posted by users, and we are not a party to any arrangement between hosts and attendees.

Alcohol and other substances. Events on Motion can be almost anything a host chooses to create, including private parties, bar nights, and other gatherings where alcohol may be served or present. Motion does not supply, sell, serve, or provide alcohol or any other substance, does not monitor events in person, and has no way to verify what happens at an event once it starts. If you host an event where alcohol will be served or present, you are solely responsible for complying with all applicable laws, including laws on serving alcohol only to those 21 or older, venue permits and occupancy limits, and any liability you may hold as a host under the law of your state (sometimes called "social host" or "dram shop" liability). Motion does not permit illegal drug use or illegal activity at any event, and hosts and attendees are solely responsible for their own conduct and for following the law. If you believe an event or user is promoting illegal activity, report it in the app or email team@motioneventco.com.

5. Attending Events

Events on Motion are hosted by other users and businesses, not by Motion. We do not screen users, run background checks, or verify that events are accurate or safe. Use good judgment when you meet people in person.

Some simple steps help: meet in public places when you can, tell a friend where you're going, arrange your own ride, and leave any situation that feels unsafe. If you are ever in danger, call 911.

Connections and phone numbers. When you and another user accept each other's connection request, you can each see the other's phone number. Only accept requests from people you are comfortable sharing it with. You can remove a connection or block a user at any time, but we cannot take back a number someone has already seen or saved.

You attend events at your own risk. To the fullest extent the law allows, you release Motion from any claims, injuries, losses, or damages that come from your participation in an event or your interactions with other users, hosts, or businesses, whether online or in person. This includes, without limitation, any claims arising from alcohol or other substances present at an event, whether or not Motion, the host, or a third party provided them.

6. Business Partners, Deals, and Offers

Bars, restaurants, clubs, and other businesses may promote deals and discounts through Motion. Each offer is provided by that business, not by Motion. The business sets the offer's details, limits, and expiration, and decides whether to honor it.

We are not responsible for the quality, safety, or legality of any partner's products, services, or venue, or for a business's decision not to honor an offer. Offers have no cash value unless the business says otherwise. Offers involving alcohol are only for people 21 and older, and the business may check ID.

7. Your Content

You own the photos, event details, and other content you post on Motion ("Your Content"). By posting it, you give Motion a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and share Your Content to operate, improve, and promote the Service. For example, we may show a public event on the map, on other users' For You pages, or in a social media post promoting Motion.

This license ends when you delete the content or your account, except for content others have already shared or saved, and copies kept in backups for a limited time.

You are responsible for Your Content. You confirm that you have the rights to post it and that it does not break these Terms or the law. We may remove any content at any time.

8. Motion's Content, Privacy, and Third-Party Services

The Motion name, logo, app design, and software belong to Motion Group LLC. We give you a personal, limited, non-transferable license to use the Service as these Terms allow. You may not copy, modify, sell, or reverse-engineer any part of it.

Our Privacy Policy explains how we collect and use your information.

The Service relies on third-party services, such as Apple MapKit for maps, and may link to other websites. Those services have their own terms, and we are not responsible for them.

9. Suspension and Termination

You can stop using Motion and delete your account at any time in the app's account settings or by emailing team@motioneventco.com.

We may suspend or close your account, remove your content, or limit your access if you break these Terms, create risk for other users or Motion, or if the law requires it. We will try to tell you why when it is reasonable to do so. Sections 5, 7, 10, and 11 still apply after your account ends.

10. Disclaimers, Limitation of Liability, and Indemnification

Disclaimers. The Service is provided "as is" and "as available." To the fullest extent the law allows, Motion makes no promises or warranties of any kind, including that the Service will be error-free or always available, or that events, users, hosts, or offers are accurate, safe, or legal.

Limitation of liability. To the fullest extent the law allows, Motion and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. This includes damages arising from events, other users, hosts, or partner businesses. Our total liability to you for any claim related to the Service is limited to $100.

Indemnification. You agree to defend and hold Motion harmless from any claims, losses, or costs, including reasonable attorneys' fees, that come from your use of the Service, your content, events you host, or your breaking these Terms or the law.

Some states do not allow certain of these limits, so parts of this section may not apply to you.

11. Disputes and Governing Law

If you have a problem with Motion, please email us at team@motioneventco.com first. Most issues can be resolved informally, and we will try in good faith to do so within 30 days.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any legal action that is not resolved informally must be brought in the state or federal courts located in Utah County, Utah, and you and Motion agree to those courts' jurisdiction. Either of us may bring a qualifying claim in small claims court instead.

12. Apple App Store Terms

If you downloaded Motion from Apple's App Store, these extra terms apply:

  • These Terms are between you and Motion, not Apple. Motion, not Apple, is responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any warranty that applies, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the app.
  • Apple is not responsible for any claims about the app, including product liability claims, claims that the app fails to meet legal requirements, or consumer protection claims.
  • If anyone claims the app infringes their intellectual property, Motion, not Apple, is responsible for handling that claim.
  • You confirm you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes and Contact

We may update these Terms from time to time. When we do, we will change the effective date at the top. If the changes are significant, we will let you know through the app or by email before they take effect. Continuing to use Motion after an update means you accept the new Terms.

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the full agreement between you and Motion about the Service.
